New Florence Owner LLC applied for authorization to either discharge to waters of the state, or to operate a no-discharge wastewater treatment facility. The department proposes to issue a Missouri State Operating Permit for the Project Green Domestic Wastewater Treatment Plant, subject to certain effluent limitations, schedules and special conditions. This plant is proposed to be located in the vicinity of Fairview and Ellis roads in New Florence, Missouri, and discharging to a classified water body Presumed Use Stream (water body ID 5024). In response to recent requests, the department is holding two public meetings about the draft permit. Please follow the public meeting links below for more information about each meeting.
The department invites the public to review and offer written comments on the proposed permit conditions until Nov. 21, 2026. All comments must be received or postmarked by midnight. The public can review the proposed permit conditions below. Other relevant information is available for review and copying upon request.
The department will consider all written comments including emails, faxes and letters in the formulation of all final determinations regarding the application. The proposed permit for these operations are consistent with applicable water quality standards, effluent standards or treatment requirements or suitable timetables to meet these requirements (see 10 CSR 20-7.015 and 7.031). The department can only consider comments about issues relating to the proposed action and permit and the effect on water quality. The department cannot consider comments or objections to a permit based on issues outside the authority of the Missouri Clean Water Commission (see Curdt v. Mo. Clean Water Commission, 586 S.W.2d 58 Mo. App. 1979).
At the end of the public comment period, the department will review all written comments and any comments given at the public meeting. Written comments and oral public meeting testimony are treated with equal consideration. We can change or deny the final permit based on technical or legal issues brought up by the comments. We will write a summary and response to all comments and explain how each was addressed in making a final decision regarding the permit. The department will issue a final decision only after the public comment period has ended, all comments have been reviewed, and written responses have been prepared to address the comments.
