The purpose of this proposed rule amendment is to add affirmative defense provisions back to the rule. Due to a court ruling reversing a rulemaking removing the provisions from federal Title 5 Permitting rule, EPA rescinded the 2023 Affirmative Defense Rule. The state rule was amended to remove those provisions as required by the rule before it was rescinded. After the court ruling, the department requested EPA not remove the provisions from the rule included in Missouri's approved state implementation plan (SIP). This action adds the provisions back to the rule to align with the court decision, federal Title 5 Permitting rule, and SIP-approved version of the rule. For additional details please see the rulemaking report.
