The Missouri Department of Natural Resources developed draft Standard Conditions Part 4 to outline specific conditions for industrial stormwater permits. The department invites the public to review and offer written comments on the proposed standard conditions until Aug. 30, 2026. All comments must be received or postmarked by 5 p.m. The public can review the proposed standard conditions below. Other relevant information is available for review and copying upon request.

Written comments may be submitted by mail to Missouri Department of Natural Resources, Water Protection Program, ATTN: NPDES Operating Permits/ Permit Comments, PO Box 176, Jefferson City, MO 65102-0176 or by email to publicnoticenpdes@dnr.mo.gov. Please include "Standard Conditions 4" in the comment letter. The department can only consider comments about issues relating to the proposed standard conditions and the effect on water quality. The department cannot consider comments or objections to a permit based on issues outside the authority of the Missouri Clean Water Commission (see Curdt v. Mo. Clean Water Commission, 586 S.W.2d 58 Mo. App. 1979).

Standard conditions are the minimum conditions that apply to all National Pollutant Discharge Elimination System (NPDES) permits, unless superseded by requirements specific in a permit or when activities, actions or practices are not relevant to a facility, site or permittee. The proposed Standard Conditions Part 4 incorporate permit conditions for stormwater requirements under the Missouri Clean Water Law and regulations pursuant to 10 CSR 20-6.200 and federal stormwater regulations under 40 CFR 122.26. The proposed standard conditions are tentative pending public comment.
