The department proposes to issue a Section 401 Water Quality Certification to The Doe Run Resources Co., subject to general or special conditions. The department invites the public to review and offer written comments on the proposed certification conditions until June 8, 2026. The public can review the proposed certification conditions below. Please include the certification number in the comment letter.

The Doe Run Resources Co. requested Section 401 Water Quality Certification to accompany the U.S. Army Corps of Engineers' (USACE) Permit for Nationwide Permit (NWP) 38 for “Cleanup of Hazardous and Toxic Waste,” to cover multiple locations under the Doe Run Viburnum Trend Aquatic Restoration Project. Programmatic water quality certification is denied for projects authorized by NWP 38. Although intended to result in minimal impacts, NWP 38 authorizes activities that may contribute to impairments and result in noncompliance with Missouri’s general water quality criteria [10 CSR20-7.031(4)]. Since programmatic water quality certification conditions cannot be established to address all concerns from the variety of impairments and activities authorized by NWP 38, an individual water quality certification is required and, therefore, being issued. This certification is being issued under Section 401 of Public Law 95-217, the CWA of 1977 and subsequent revisions. Pursuant to Section 121.7(d), this office certifies the proposed project will comply with Missouri water quality requirements
