The city of Jackson requested approval to implement and enforce a modification to its approved wastewater pretreatment program. The department reviewed the proposal and intends to approve the plan modification. The department invites the public to review and offer written comments on the proposed pretreatment program modification until June 8, 2026. All comments must be received or postmarked by 5 p.m. The public can review the proposed program modification below. Other relevant information is available for review and copying upon request.

The city is proposing to retain and revise local limits to include cyanide, copper, nickel, zinc, BOD, TSS and Total Kjeldahl Nitrogen. The city proposes to adopt these local limits into the city’s legal authority as maximum allowable industrial loading (MAIL) and implemented as maximum daily limits, allocated based on need. Additionally, the city proposes omitting silver, arsenic, cadmium, chromium, mercury, molybdenum, lead and selenium, due to not being identified as a pollutant of concern. The city also proposes to implement and adopt a reserve MAIL for phosphorus and total nitrogen, as emerging pollutants. The city’s modification also included Sewer Use Ordinance (SUO) modifications to reflect changes related to the local limit updates. The city’s pretreatment program changes were designated substantial modifications because these changes could have a significant impact on the operation of the program, pursuant to 40 CFR 403.18(b)(7).

The department can only consider comments about issues relating to the proposed action. The department cannot consider comments or objections based on issues outside the authority of the Missouri Clean Water Commission. The proposed department approval is tentative pending public comment. The notice of request for approval will be approved if no comments are received by the date specified in this notice, no substantive comments are received, and the request is approved without change.
