A proposed amendment to Code of State Regulations 10 CSR 10-6.070 New Source Performance Regulations, is now available for public review and comment until June 4, 2026. The department will hold a public hearing about the proposed amendment on May 28, 2026, during the regularly scheduled Missouri Air Conservation Commission meeting. The main purpose of this proposed amendment is to adopt by reference updates to previously adopted 40 CFR 60 subparts that were promulgated from July 1, 2024, through June 30, 2025. The EPA requires regular updates to this regulation in order for the state to adequately administer its Title 5 permits program. The update is also an obligation under the department/ EPA Performance Partnership Grant work plan. If the standards are not updated on a regular basis, the EPA is obligated to implement a federal operating permits program. For additional details please see the rulemaking report.
