City of Perryville has requested approval to implement and enforce a modification to its pretreatment program to regulate industrial discharges to the district's wastewater treatment facilities. The department has reviewed the proposal and intends to approve the plan modification. The department invites the public to review and offer written comments on the proposed pretreatment program modification until April 6, 2026. All comments must be received or postmarked by 5 p.m. Interested parties may review the proposed program modification below. Additional information is available for review and copying upon request.

The City’s modification to the Pretreatment Program includes: 1) update local limits as Maximum Allowable Industrial Loading for the Central and North wastewater treatment facilities, which include new parameters and newly omitted parameters. Local Limits will not be implemented at the Southeast Facility, at this time; 2) Sewer Use Ordinance (SUO) modifications were included to communicate changes related to the local limit updates; and 3) The City’s Enforcement Response Plan (ERP) was updated to a format which specifically incorporates escalating enforcement actions and outlines consistent enforcement and personnel involved for various levels of noncompliance with the Pretreatment Program. The ERP was also updated to incorporate a point-based system and will utilize modifiers to characterize nature, severity, and frequency of violations with consideration of compliance history. Additionally, the ERP will incorporate the city’s updated fine authority. The City’s Pretreatment Program changes were designated substantial modifications because the City modified its SUO to include updated local limits after conducting a detailed local limit analysis that is part of this program modification. These changes could have a significant impact on the operation of the program, pursuant to 40 CFR 403.18(b)(7).

Written comments may be submitted by mail to Missouri Department of Natural Resources, Water Protection Program, ATTN: Pretreatment Coordinator, PO Box 176, Jefferson City, MO 65102-0176 or by email to pretreatment@dnr.mo.gov. Please include the permit number in the comment letter. The department can only consider comments about issues relating to the proposed action. The department cannot consider comments or objections based on issues outside the authority of the Missouri Clean Water Commission. The proposed department approval is tentative pending public comment. The notice of request for approval will be approved if no comments are received by the date specified in this notice; where no substantive comments are received, the notice of intent for approval is approved without change.
