The department proposes to issue a variance for the Petunia Wastewater Treatment Plant. The department invites the public to review and offer written comments on the proposed variance conditions. All comments must be received or postmarked by Oct. 6, 2025. The public can review the proposed variance conditions below.

The department can only consider comments about issues relating to the proposed action and the potential effect on facility operations and water quality.

Missouri Clean Water Commission regulation 10 CSR 20-8.160(3)(A), Table 160-1, requires at least 300-foot separation from the proposed wastewater treatment facility and potable water sources. The new wastewater treatment facility is proposed to serve the existing duplex residence at 506 and 508 Petunia Road. However, due to the size of the property, the proposed wastewater treatment facility does not meet the 300-foot separation required by 10 CSR 20-8.140(2)(C)1. from the drinking water wells. Any deviation from the regulation requires a variance approved by the Clean Water Commission. On the basis of preliminary staff review and the application of applicable state and federal regulations, the Missouri Department of Natural Resources, as administrative agent for the Missouri Clean Water Commission, has found that an individual variance pursuant to Missouri Revised Statute 644.061.1, RSMo is warranted. The department proposes to recommend approval of the variance CWC-V-2-25. The proposed recommendation is tentative pending public comment.
