The department proposes to issue a Section 401 Water Quality Certification to George and Dana Heath, subject to general or special conditions. The department invites the public to review and offer written comments on the proposed certification conditions until July 31, 2025. The public can review the proposed certification conditions below. Other relevant information is available for review and copying upon request. Written comments may be submitted by mail to Missouri Department of Natural Resources, Water Quality Certification, PO Box 176, Jefferson City, MO 65102-0176 or by email to wpsc401cert@dnr.mo.gov. Please include the certification number in the comment letter.

George and Dana Heath requested Section 401 Water Quality Certification to accompany the U.S. Army Corps of Engineers' (USACE) Permit NWK-2023-00040. The project is located at the following coordinates near Warrenton, Missouri: 38.744606°N and -91.318998°W. The proposed project includes building a 52-foot high earthen dam over Cullum Branch Creek to impound the upstream valley. The effected water bodies include Cullum Branch Creek and an unnamed tributary to Cullum Branch Creek. The final reservoir is designed to impound 25 surface acres, impacting 4,395 linear feet of stream. In addition to dam construction and associated clearing, a haul road will impact 120 linear feet of stream.
