A proposed amendment to Code of State Regulations 10 CSR 10-6.065 Operating Permits, is now available for public review and comment until Sept. 5, 2024. All comments must be received or postmarked by 5 p.m. The department will hold a public hearing about the proposed amendment on Aug. 29, 2024. Please follow the link below for more information.

This proposed rule amendment has two purposes. First, sections relating to Emergency Affirmative Defense are being removed in order to comply with EPA Title V Operating Permit Program regulations. Effective Aug. 21, 2023, EPA removed the Emergency Affirmative Defense Provisions located in 40 CFR 70.6(g), requiring state permitting programs to amend their title V programs. Second, this amendment updates the fee structure for operating permits beginning Jan. 1, 2026, according to the fee structure revisions agreed to in fee stakeholder meetings.
