This permit authorizes the discharge of wastewater and stormwater associated with petroleum impacted water at any industrial or commercial facility from short-term or long-term remediation activities. These activities may include fuel spill remediation, wastewater from storage tank equipment management, underground storage tank removals, wastewater generated during the installation of wells for the purpose of monitoring contaminated groundwater, pumping of contaminated groundwater, pit dewatering, containment sump testing and equipment cleaning.
This permit authorizes the operation of oil water separators for the treatment of wastewater and stormwater. The oil water separators must be appropriately operated and sized per manufacturer’s or engineering specifications. This permit does not authorize the construction and operation of Underground Injection Control wells used to inject fluids underground.
Facilities discharging all effluent directly to a combined sewer system connecting to a publicly owned treatment works that has consented to receive such a discharge are exempt from stormwater permit requirements. A permit is not required for a de minimis discharge of potentially impacted water from a petroleum storage, as explained by the MOG94 de minimis guidance document.
Length of Permit
The department issues this general permit for a five-year period. The effective date is Sept. 1, 2022 and expires Aug. 31, 2027. If a facility applies for and receives this permit on Oct. 16 2025, their permit will expire Aug. 31, 2027.
