Permits Needed for Asphalt Company Businesses

If your business is required to obtain a Part 70 Operating Permits but accepts voluntary, practically enforcement limitation to reduce emissions to less than 100 tons per year of any regulated pollutant and is less than 10 tons per year of any single hazardous air pollutant and less than 25 tons per year of any combined hazardous air pollutant, you may require an Air Intermediate Operating Permit to address potential air emissions.

If your business plans to construct a new installation or modify an existing minor installation and the project has the potential to emit more than major emission levels of a regulated air containment or construct a new installation or modify an existing major installation and the project has the potential to emit more than the minor levels per year, you may require an Air Major Construction Permit Sections (7), (8) & (9) to address potential air emissions.

If your business plans to construct a new installation or modify an existing minor installation and the project has the potential to emit less than major source levels per year; or you plan to construct a new installation or modify an existing major installation and the project has the potential to emit less than the minor levels per year, you may require an Air Minor Construction Permit to address potential air emissions.

If your business has the potential to emit greater than 100 tons per year of any regulated pollutant, has the potential to emit greater than 100 tons per year of any single hazardous air pollutant, or greater than 25 tons per year of combined hazardous air pollutants, or is required by a New Source Performance Standard or a Maximum Achievable Control Technology, you may require an Air Part 70 Operating Permit.

If you or your business produce or store some form of hazardous waste as a result of your business processes, you may be required to register as a hazardous waste generator.

If you or your business own or operate a hazardous waste treatment facility and want to use new and experimental treatment technologies for which no regulatory standards exist, you may apply for a Research, Development and Demonstration Permit.

If you or your business plans to transport used oil, hazardous waste (combustible liquids, corrosives, poisons/ toxins, flammable liquids, flammable solids, PCB's) or infectious waste in Missouri, you are required to obtain a Hazardous Waste Transporter License.

Even though the request is approved by both Missouri Department of Transportation (MoDOT) and the Missouri Department of Natural Resources, you must apply for and renew the license through MoDOT. For more information, please visit MoDOT's Hazardous Waste Transport webpage.

Open burning is the burning of any materials in which air contaminants are emitted directly into the air without first passing through a stack or chimney. The Missouri Department of Natural Resources does not issue permits for open burning. Prior to conducting any open burning, businesses and citizens should contact the city or county of jurisdiction for any local restrictions.

The department's Facts on Open Burning Under Missouri Regulations - PUB2047 fact sheet summarizes allowable and prohibited open burning under Missouri regulations. It does not include open burning restrictions that city or county governments may impose in addition to Missouri’s state regulations. 

If your business plans to construct a public water system that will supply drinking water to the public, you must obtain a Public Drinking Water Construction Permit. A public water system has at least 15 service connections or serves at least 25 people at least 60 days out of the year. This permit is also required if you plan to complete the following construction projects to the water system: waterline extensions, waterline replacements, drilling water supply well, construction a storage tank, adding a disinfection system, treatment changes, building a pump station or other improvements or modifications.

If your business plans to connect to a permitted public water system, then you are not required to obtain this permit.

If your business plans to operate a public water system that supplies drinking water to the public, you must obtain a Public Drinking Water Permit to Dispense. A public water system has at least 15 service connections or serves at least 25 people at least 60 days out of the year.

If you or your business plans to transport scrap tires (tires that are no longer suitable for their original intended purpose because of wear, damage or defect) for profit within Missouri, you are required to obtain a Waste Tire Transporter License, also known as a Scrap Tire Hauler Permit. The Solid Waste Management Law requires certain scrap tire haulers to obtain a Waste Tire Hauler Permit. You are exempt from this requirement if your activity falls into one of the following categories, provided you do not create pollution, a public nuisance or a health hazard:

• Do not haul for consideration (monetary or non-monetary compensation) or commercial profit
• Hauling warranty tires or new defective tires to the retailer, wholesaler or manufacturer for adjustment credit or return
• Hauling scrap tires that were generated at their own business or residence, provided that this transportation is done using their own employees and vehicles

If you do not meet any of the exemptions listed above, then you are required to obtain a Waste Tire Hauler Permit from the Missouri Department of Transportation (MoDOT). If your business includes an underground storage tank on the property used to store either petroleum or certain hazardous substances, or if you plan to have a tank installed for these reasons, you may be required to submit an Underground Storage Tank Registration with the department.
