City of Lamar Proposed Pretreatment Program Modification Public Comment Period, Dec. 1, 2023 to Jan. 2, 2024

The City of Lamar notified the department of a new industrial process wastewater source introduced into the city's wastewater system.

The City of Lamar notified the department of a new industrial process wastewater source introduced into the city's wastewater system. The facility will now meet the definition of a significant industrial facility and therefore the city is required to reactivate their Industrial Pretreatment Program to meet the requirements of the Clean Water Law. The department reviewed the proposal and intends to approve the plan. The department invites the public to review and offer written comments on the proposed pretreatment program modification until Jan. 2, 2024. All comments must be received or postmarked by 5 p.m. The public can review the proposed permit conditions below. Other relevant information is available for review and copying upon request. 

Written comments may be submitted by mail to Missouri Department of Natural Resources, Water Protection Program, ATTN: Pretreatment Coordinator, PO Box 176, Jefferson City, MO 65102-0176 or by email to pretreatment@dnr.mo.gov. Please include the permit number in the comment letter. The department can only consider comments about issues relating to the proposed action. The department cannot consider comments or objections based on issues outside the authority of the Missouri Clean Water Commission. The proposed department approval is tentative pending public comment. The modification request will be approved if no comments are received by the date specified in this notice; where no substantive comments are received, the notice of intent for approval is approved without change.

The city conducted a technical evaluation of the need to revise local limits. The city’s proposed 
allocation of the Maximum Allowable Industrial Loading uses the approach which allows for 
case-by-case allocation of conventional pollutants and metals. The city has placed general 
language about complying with local limits in the local Sewer Use Ordinance and place 
established specific limits through site specific control mechanisms.

The submittal also includes proposed legal authority updates to the city’s Pretreatment Code per 
Special Condition 23(c) which requires that the pretreatment legal authority be updated to 
incorporate the Streamlining Rule changes per 40 CFR 403 which the State adopted October 30, 
2012, (10 CSR 20-6.100). The city submitted Part 1- Local Limit Review: Technical Evaluation 
Report, which concluded that the city does not need to implement any local limits. The city 
previously had metals or conventional pollutants established in ordinance. The city concluded in 
the local limit review report that the implementation of metal or conventional pollutants is not needed, and thus are removing the pollutants from the sewer use ordinance.
