A proposed amendment to Code of State Regulations 10 CSR 10-6.161 Commercial and Industrial Solid Waste Incinerators, is now available for public review and comment until Sept. 7, 2023. All comments must be received or postmarked by 5 p.m. The department will hold a public hearing about the proposed amendment on Aug. 31, 2023. Please follow the link below for more information.

The purpose of this proposed rule update is to correct incorporations by reference and align the language with other rules in 10 CSR 10-6. The federal statute requiring this rule is Clean Air Act (CAA) Section 129. Section 129 of the CAA requires the Administrator to develop regulations under Section 111 of the CAA, limiting emissions of nine air pollutants from four categories of solid waste incineration units: municipal solid waste; hospital, medical and infectious solid waste; commercial and industrial solid waste; and other solid waste.
