The department proposes to issue a Section 401 Water Quality Certification to the U.S. Army Corps of Engineers, subject to general or special conditions. The department invites the public to review and offer written comments on the proposed certification conditions until April 20, 2023. The public can review the proposed certification conditions below. Other relevant information is available for review and copying upon request. The U.S. Army Corps of Engineers' (USACE) St. Louis District requested a Section 401 Water Quality Certification to accompany their MVS Regional General Permit (RGP)-44 Missouri. MVS RGP-44 was originally issued by the St. Louis District in March 2018 and expired March 16, 2023. The permit authorizes the discharge of fill material into existing improved stormwater channels or basins, previously constructed in or considered waters of the U.S. The projects must be considered maintenance or replacement necessary to maintain functionality and the integrity of public stormwater, sanitary and combined sewer systems. This general permit does not authorize new stormwater projects built in natural streams or wetland areas.
