Construction permits allow an installation to construct and operate an air emission source. Construction permits are required prior to commencing construction of an emission source and may be obtained by submitting a completed application. Construction may not begin until a construction permit has been issued. In certain cases, an applicant may apply for a pre-construction prohibition waiver to begin construction prior to receipt of the approved permit.
Regulated activities include the construction of a temporary installation or pilot plant with a potential to emit less than 100 tons of each pollutant per year.
Length of Permit
Temporary permits are valid for a period not longer than two years from the date of issuance, dependent upon the type of activity.
