Final Hazardous Waste Permit Termination

On Feb. 9, 2023, the department approved the proposed final remedy of “no further corrective action with institutional and engineering controls” for the Holcim (US) Inc./ Geocycle LLC facility. As a result of that approval, the department will terminate Holcim/Geocycle's Missouri Hazardous Waste Management Facility Part I Permit and release the facility from regulation as a hazardous waste treatment, storage and disposal facility subject to the corrective action and permitting requirements of the Missouri Hazardous Waste Management Law and regulations. 

Holcim/Geocycle's Part I Permit termination will become effective March 10, 2023. Any parties adversely affected or aggrieved by the department’s decision to approve the final remedy, or terminate the Part I Permit, may be entitled to pursue an appeal before the Administrative Hearing Commission, according to Code of State Regulations 10 CSR 25-8.124(2). The written petition must be filed with the Administrative Hearing Commission by March 10, 2023, according to the procedures outlined in 10 CSR 25-2.020 and Missouri Revised Statutes, sections 260.395.11 and 621.250, RSMo. The Holcim/Geocycle facility is located at 14744 Highway 79 North, two miles north of Clarksville. Holcim operated a wet process cement kiln, which produced clinker, the main ingredient in Portland cement. Holcim used mainly coke and coal to heat the kiln system, supplemented by a variety of liquid and solid hazardous waste-derived fuels. Geocycle operated the hazardous waste treatment and storage facility. Holcim and Geocycle operated under two hazardous waste permits, a department-issued Missouri Hazardous Waste Management Facility Part I Permit and EPA-issued Hazardous and Solid Waste Amendments Part II Permit. Holcim/Geocycle closed the hazardous waste management facility in 2009, which included the hazardous waste fuel facility, cement kiln and hazardous waste fuel feed system piping. Holcim/Geocycle’s site closure cleanup, corrective action activities and dismantling operations lasted through 2017.

The department determined that Holcim/Geocycle closed its facility according to the approved closure plan and met the requirements of federal and state laws and regulations. Based on currently available information, no additional cleanup is required at the facility. After a thorough technical review of several investigation reports and sampling results and opportunity for public comment, the department approved the final remedy of no further corrective action. The department and EPA will terminate Holcim’s hazardous waste permits and release the facility from regulation as a hazardous waste treatment, storage and disposal facility subject to corrective action and permitting requirements. EPA anticipates terminating the Part 2 permit after the department terminates the Part 1 permit. All conditions of the existing permits will remain in effect until the permit termination is finalized.
