The Missouri Department of Natural Resources prepared a Statement of Basis in support of a proposed final remedy for the BP Products North America Inc. facility. The department invites the public to review and offer written comments on the proposed final remedy until Oct. 12, 2023.

BP Products, formerly BP Amoco, operated an oil refinery at the site, located at 1000 N. Sterling Ave. in Sugar Creek, Missouri. A complex system of underground pipes carried crude oil to the refinery, which was processed into petroleum products and eventually fuels, such as gasoline and jet fuel. Amoco owned the refinery in 1982, when it decided to shut down the processing activities, before the Missouri Hazardous Waste Management Law and federal Hazardous and Solid Waste Amendments existed. Refinery documents dated as early as 1950 described tank and pipe leaks and petroleum product spills. Petroleum product was found in natural springs west of the refinery, leaking through a retaining wall that separated the city creek, also named Sugar Creek, from the refinery, and underneath a nearby residential area.
BP Products currently is conducting corrective action investigations and remediation activities at the site. The site was divided into several small areas, each being investigated under a 3008(h) Corrective Action Administrative Order on Consent with the U.S. Environmental Protection Agency (EPA). BP submitted a Consolidated Final Remedy Proposal to the department, which identified and evaluated possible corrective measure alternatives, including BP’s preferred final remedy, for removing, controlling or treating on-site soil, groundwater, surface water and sediment contamination that may present an unacceptable risk.
After a through technical review of BP Products preferred final remedy and other remedial alternatives, the department prepared a Statement of Basis that summarizes the remedial alternatives and the department's basis of support for the proposed final remedy. If approved, implementation of the approved remedy will be regulated by a Corrective Action Abatement Order on Consent, signed by the department and BP in 2005.

An Open Records/ Sunshine Law Request will need to be submitted to review or obtain copies of the department's files.
Comments on the proposed final remedy are more effective if they point out legal or technical issues or provide information that is not in the record.
