The department proposes to issue a variance for the Cup Tree Road Wastewater Treatment Facility. The department can only consider comments about issues relating to the proposed action and the potential effect on facility operations and water quality.
Missouri Clean Water Commission regulation 10 CSR 20-8.160(3)(A), Table 160-1, requires a minimum side water depth of 12 feet for secondary clarifiers following an activated sludge process. The proposed dual hopper rectangular clarifier will have a side water depth of 7 feet 4 inches, with a total water depth of 12 feet. Any deviation from the regulation requires a variance approved by the Clean Water Commission. On the basis of preliminary staff review and the application of applicable state and federal regulations, the Missouri Department of Natural Resources, as administrative agent for the Missouri Clean Water Commission, has found that an individual variance pursuant to Missouri Revised Statute 644.061.1, RSMo is warranted. The department proposes to recommend approval of the variance CWC-V-5-2024. The proposed recommendation is tentative pending public comment.
