The department prepared a draft Missouri Hazardous Waste Management Facility Part I permit for the Bayer CropScience LLP facility. The department, in coordination with EPA, also prepared a Statement of Basis that summarizes the remedial alternatives and the department’s basis of support for a proposed final remedy at the Bayer facility. The department invites the public to review and offer written comments on the proposed final remedy and draft permit until Nov. 1, 2021. Written comments may be submitted by mail to Bryce Bobbitt, Missouri Department of Natural Resources, PO Box 176, Jefferson City, MO 65102-0176 or by email to email@example.com.
Bayer currently is operating and performing corrective action activities at the facility under two hazardous waste permits. The department issued a Missouri Hazardous Waste Management Facility Part I Permit. The U.S. Environmental Protection Agency issued a Hazardous and Solid Waste Amendments Part II Permit. In September 2008, Bayer submitted a permit application to the department and EPA, to renew and update its existing hazardous waste permits, which expired Jan. 8, 2009. The permits were continued in effect, as allowed by 10 CSR 25-7.270(1), incorporating 40 C.F.R. § 270.51, until the department and EPA issue or deny new hazardous waste permits. Bayer also submitted a final Corrective Measures Study Report, which identified and evaluated possible corrective measure alternatives, including Bayer's preferred final remedy.
After a thorough technical review of the permit application and Bayer's preferred final remedy and other remedial alternatives, the department prepared a draft Part I Permit. EPA will not be issuing a Part II Permit, since EPA has no site-specific conditions for the Bayer facility and Missouri is fully authorized for all permitting and corrective action activities at the facility. The pubic can review an electronic copy of the draft permit, Statement of Basis and fact sheet below. Paper copies of the permit application, Statement of Basis, draft Part I Permit and supporting documents are available at the Kansas City Public Library’s Sugar Creek Branch, 102 S. Sterling Ave., Sugar Creek, MO (during normal business hours) or the Missouri Department of Natural Resources, Elm Street Conference Center, Jefferson City, MO 65102. An Open Records/ Sunshine Law Request will need to be submitted to review or obtain copies of the department's files. During the public comment period, anyone can request a public meeting or public hearing about the draft permit. For more information, please contact Bryce Bobbitt.
