The department proposes to issue a Section 401 Water Quality Certification to The Doe Run Co., subject to general or special conditions. The department invites the public to review and offer written comments on the proposed certification conditions until July 14, 2022. The public can review the proposed certification conditions below. Other relevant information is available for review and copying upon request. Written comments may be submitted by mail to Missouri Department of Natural Resources, Water Quality Certification, PO Box 176, Jefferson City, MO 65102-0176 or by email to wpsc401cert@dnr.mo.gov. Please include the certification number in the comment letter.

Genevieve Sutton, representing The Doe Run Co., requested Section 401 Water Quality Certification accompany the U.S. Army Corps of Engineers' (USACE) Nationwide Permit 38 for “Cleanup of Hazardous and Toxic Waste”, to cover multiple locations under the Doe Run Viburnum Trend Aquatic Restoration Project. This certification covers additional restoration project locations within the Viburnum Trend not previously requested or authorized by Section 401 Water Quality Certification CES003075, issued on Feb. 22, 2022. The project includes remedial sediment removal at various locations in Sweetwater Tributary within the Little Rock USACE Regulatory District. Proposed plans include excavating sediment from specific locations to remove lead from the aquatic environment, requiring one temporary crossings and entry/ exit points on the streambanks. The project will be governed by the Sediment Excavation Master Plan (SEMP) for the Viburnum Trend Aquatic Restoration and will include 20 linear feet of temporary stream crossing impacts, 240 linear feet of temporary stream entry/ exit impacts and 1,032 linear feet of gravel bar sediment removal.
