The regulatory impact report (RIR) for proposed revisions to 10 CSR 20-6.010, Construction and Operating Permits, is now available for public review and comment until March 24, 2022. Written comments may be submitted by mail to Steven Hamm, Missouri Department of Natural Resources, Water Protection Program, P.O. Box 176, Jefferson City, MO 65102-0176 or online through the Regulatory Action Tracking System. Please include your contact information: name, email address and phone number.

An RIR is required at the beginning of the rulemaking process for rules recommending environmental standards or conditions. It documents the environmental and economic costs and benefits associated with the proposed rule changes. The department invites the public to review and submit comments to help ensure that our regulations provide required protections but do not add unneeded costs. Only the RIR is open for public comment at this time. The proposed rule will be open for public comment at a later date.

The proposed rule amendment would require applicants submit electronic versions of applications and makes submitting paper copies optional, unless required by department request. This amendment will clarify the construction permit application exemption in 10 CSR 20-6.010(5)(B)3 to be consistent with the statutory requirement that industrial lagoon systems must get a permit. The proposed rule amendment will also clarify that both industrial no-discharge permits and industrial stormwater permits are exempt from the higher level continuing authority requirements in 10 CSR 20-6.010(2)(B) and (C).
