Final Hazardous Waste Permit

On Oct. 13, 2023, the Missouri Department of Natural Resources issued a final Missouri Hazardous Waste Management Facility Part 1 Permit for the SpecGX LLC facility, effective immediately. Any parties adversely affected or aggrieved by the department’s decision to issue the final permit, or specific conditions of the permit, may be entitled to pursue an appeal before the Administrative Hearing Commission by filing a written petition by Nov. 13, 2023, as more fully described on page 7 of the final Part I Permit.

SpecGx LLC, formerly Mallinckrodt Inc., operates a commercial manufacturing facility at the site, located at 3600 N. Second St. in St. Louis, Missouri. The facility currently produces a variety of medical diagnostic materials, pharmaceuticals and pharmaceutical ingredients. The facility previously operated a permitted storage area for hazardous wastes generated by these manufacturing processes, however the storage area was closed in 2014. SpecGx now only stores hazardous wastes resulting from manufacturing operations, which is currently stored for less than 90-days before being shipped off site for proper disposal. 

SpecGX currently is conducting corrective action investigations and remediation activities at the site under a department-issued Missouri Hazardous Waste Management Facility Part 1 Permit. Since any hazardous wastes at the facility are stored for less than 90 days, the storage area is not required to be permitted. Instead, the containers are managed under the generator storage requirements of the federal and state hazardous waste laws, 10 CSR 25-5.

On March 28, 2023, SpecGX submitted a permit application to the department to renew their existing hazardous waste permit. After a thorough technical review of the permit application and opportunity for public comment on the draft permit, the department issued a final Part 1 Permit. The final permit requires SpecGX to conduct further investigation and monitoring to determine the nature and extent of any past hazardous material releases to the environment resulting from past waste management and operational practices. The final Part I Permit also contains contingent corrective action conditions that may be exercised in the event there is a new release to the environment or if existing contamination poses a threat due to further migration.
