JEFFERSON CITY, MO, AUG. 14, 2017 – The Missouri Department of Natural Resources issued a final hazardous waste permit, which includes Remedial Action Plan provisions, for the BFI Missouri City Landfill facility, requiring BFI Waste Systems of North America LLC to continue performing long-term monitoring and corrective action investigation and remediation activities at the facility.
The BFI Missouri City Landfill, 8501 Stillhouse Road, Liberty, is a former hazardous waste treatment and disposal facility. From 1972 to 1983, BFINA operated several hazardous waste management units at the site, including a sanitary landfill and chemical landfill. When BFINA closed the site in the late 1980s, a multicomponent final cap was installed over all the waste management units, addressing the entire site as one unit, collectively called the closed landfill, now known as the BFI Missouri City Landfill.
BFINA has been conducting long-term groundwater monitoring and maintenance of the capped landfill and corrective action investigation and remediation activities under a department-issued Missouri Hazardous Waste Management Facility Part I Permit and EPA-issued Hazardous and Solid Waste Amendments Part II Permit. On June 18, 2010, BFINA submitted a permit application to the department and EPA, to renew and update their hazardous waste permits. In May 2013, BFINA also submitted a plan to the department and EPA, to include provisions in their Part I Permit to treat hazardous remediation waste at the facility using an on-site treatment plant. The department made the draft Part I Permit available for public review and comment from July 7, 2016, through Oct. 18, 2016.
Following review and response to all public comments, the department made minor changes to the draft permit and reissued a final Part I Permit, which requires BFINA to continue performing corrective action at the site and post-closure care for the capped landfill. The Part I Permit also includes the provisions for storing and treating the hazardous remediation wastes as proposed in the plan and permit application. EPA decided not reissue the Part II Permit, since EPA has no additional specific conditions for the facility beyond those in the Part I Permit and Missouri is fully authorized for all permitting, post-closure, corrective action, and plan activities at the facility. EPA intends to terminate the existing Part II Permit upon reissuance of the Part I Permit.
Any parties adversely affected or aggrieved by the department’s decision to issue the final Part I Permit may be entitled to pursue an appeal before the Administrative Hearing Commission by filing a petition by Sept. 13, 2017, as more fully described on page 7 of the final Part I Permit.
