Record 2
West Fork Black River
Withdrawal July 21, 2017

The department has determined that the West Fork Black River, WBID 2755, in Reynolds County, Mo., is attaining applicable water quality standards according to current listing methodology. The department has also reviewed the administrative record for this water body and determined it was incorrectly placed on the 1998 Section 303(d) List of impaired waters without sufficient and compelling reason to do so. For these reasons the department is withdrawing the TMDL for nutrients established by the EPA for West Fork Black River in December 2010. This water body was placed on Public Notice for the period of March 6, 2017 through May 5, 2017.

The TMDL being withdrawn was established to meet the milestones of the 2001 Consent Decree, American Canoe Association, et al. v. EPA, No. 98-1195-CV-W in consolidation with No. 98-4282-CV-W, Feb. 27, 2001. This public notice does not impact or affect future West Fork Black River TMDLs that will be developed to address metals in sediment impairments for this water body.
