A proposed amendment to 10 CSR 20-6.010, Construction and Operating Permits, is now available for public review and comment until Sept. 8, 2022. Written comments may be submitted by mail to Steve Hamm, Missouri Department of Natural Resources, Water Protection Program, P.O. Box 176, Jefferson City, MO 65102-0176 or online through the Regulatory Action Tracking System. Please include your contact information: name, email address and phone number.

The purpose of this proposed amendment is to require applicants submit electronic versions of applications and makes submitting paper copies optional, unless required by department request. This amendment will clarify the construction permit application exemption in 10 CSR 20-6.010(5)(B)3 to be consistent with the statutory requirement that industrial lagoon systems must get a permit. The proposed rule amendment will also clarify that both industrial no-discharge permits and industrial stormwater permits are exempt from the higher level continuing authority requirements in 10 CSR 20-6.010(2)(B) and (C). For additional details please see the rulemaking report. The department will hold a public hearing about the proposed amendment during the Missouri Clean Water Commission meeting on Sept. 1, 2022.
