On Oct. 29, 2021, the department issued a final Missouri Hazardous Waste Management Facility Part I Permit, effective immediately, for the Beazer East Inc. facility. The final permit requires Beazer to continue performing corrective action activities and long-term groundwater monitoring. EPA did not issue a Hazardous and Solid Waste Amendments Part II Permit, since EPA has no site-specific conditions for the facility, beyond those contained in the Part I Permit, and Missouri is fully authorized for all permitting, post-closure and corrective action activities at the facility.
There were no comments made on the draft Part I Permit during the public comment period. According to 10 CSR 25-8.124(2), any parties adversely affected or aggrieved by the department’s final Part I Permit decision, or specific conditions of the Part I Permit, may be entitled to pursue an appeal before the Administrative Hearing Commission (AHC). The petition must be filed with the AHC by Nov. 29, 2021, according to the procedures outlined in Missouri Revised Statutes, sections 260.395.11 and 621.250, RSMo.
