Land Reclamation Commission meeting to consider requests for hearings on southeast Missouri quarries

JEFFERSON CITY, MISSOURI, JAN. 24, 2011 -- The Missouri Land Reclamation Commission will be considering requests for hearings on two southeast Missouri quarry applications at its Jan. 27 meeting in Jefferson City.

The commission has received requests from the public for a hearing on applications submitted by Strack Excavation and Heartland Materials for limestone quarries near the southeast Missouri town of Fruitland in Cape Girardeau County.

Based on testimony given at the commission meeting Thursday or submitted in writing prior to the meeting, the commission will determine if those requesting the hearing have shown that their “health, safety or livelihood will be unduly impaired by the issuance of the permit.”

In either case, if the request for a hearing is granted, the commission will schedule at a later date a formal, courtroom-style proceeding before a hearing officer, who will function as a judge.

The Department of Natural Resources' Land Reclamation Program has recommended, based on its finding that the two businesses meet the technical requirements of the law, that both of the applications be approved. Additional information on these two applications is available online:

In addition to these hearings, the commission will also be ruling on a request to release the bond being held for the restoration of the Reidel Energy, Seelow Property, in Monroe County.

The meeting, which begins at 10 a.m., will be held in the Department of Natural Resources' Elm Street Conference Center, 1730 E. Elm St., Jefferson City.
