Missouri Air Conservation Commission hosts public meeting Feb. 3 in Jefferson City

JEFFERSON CITY, MO, -- The Missouri Air Conservation Commission will hold a public meeting at 9 a.m. on Feb. 3 in Room 450 at the Governor Office Building, 200 Madison St. in Jefferson City.

At this meeting, the commission will hear routine reports from department staff regarding permits, operations and enforcement actions. A public hearing will also be held on several rule actions including amendments to: 10 CSR 10-6.060 Construction Permits Required, 10 CSR 10-6.100 Alternate Emission Limits, and 10 CSR 10-6.410 Emissions Banking and Trading. This group of rulemakings is related to the U.S. Environmental Protection Agency's 2002 New Source review improvement rule.

Amendments to 10 CSR 10-6.350 Emission Limitations and Emissions Trading of Oxides of Nitrogen and 10 CSR 10-6.360 Control of NOX Emissions from Electric Generating Units and Non-Electric Generating Boilers will also be presented. These proposed amendments will remove sunset provisions that were added in 2007 because these rules were going to be superseded by the federal Clean Air Interstate Rule or CAIR requirements.  These rule revisions are necessary because the CAIR had been vacated by the District of Columbia Circuit Court of Appeals, pending any appeal. If the CAIR is vacated, these two oxides of nitrogen control rules will be necessary regulations for fossil fuel-fired electric generating units in Missouri. 

The 2008 Eight-Hour Ozone Nonattainment Boundary Recommendation for Missouri will also be presented for adoption. On March 12, 2008, the U.S. Environmental Protection Agency released a new eight-hour ozone standard. Release of this standard started a time clock with a deadline for this March.  The state must submit its recommendation on which areas of the state should be designated nonattainment or not meeting the new ozone standard.  

In addition, amendments 10 CSR 10-5.381 On-Board Diagnostics Motor Vehicle Emissions Inspection and 10 CSR 10-6.061 Construction Permit Exemptions, will be presented for adoption. Amendment 10 CSR 10-5.381 will clarify the exemption, inspection station, vehicle inspection and waiver requirements of the inspection/maintenance program rule in the St. Louis Ozone Nonattainment Area. Amendment 10 CSR 10-6.061 will add an exemption from construction permits for the construction of temporary storage structures throughout Missouri that occur as a result of exceptional events (e.g. natural disasters or abundant harvests exceeding available storage capacity).

The proposed documents are available for review at Air Pollution Control Program, 1659A E. Elm St. in Jefferson City.  The documents are also available on the Public Notice section of the department's website at www.dnr.mo.gov/env/apcp/index.html.

The department requests citizens who intend to give verbal presentations on the proposed rule actions also provide a written copy of their testimony to the commission secretary at the time of the public hearing. The department also will accept comments until 5 p.m. on Feb. 10.
