What is the CAFO Workgroup?
The Missouri Department of Natural Resources’ Water Protection Program is proposing changes to Missouri’s CAFO water quality regulation. The current regulation can be found at 10 CSR 20-6.300 and is being revised due in part to recent changes to the U.S. Environmental Protection Agency CAFO regulations. In addition, the department is proposing a new CAFO regulation that focuses on the engineering design and permit application process, which will be located at 10 CSR 20-8.300.
The Missouri CAFO Rule Workgroup is an informal and voluntary public participation activity conducted in addition to the formal public participation process required for formal rulemaking. The Missouri Clean Water Commission will conduct a public hearing and accept comments on the draft rule after publication in the Missouri Register. The workgroup’s primary purpose is to provide engaged stakeholders an enhanced opportunity to provide input and comment on proposed rulemaking changes. In addition, the workgroup meetings will give the department the opportunity to present and explain the new federal regulation along with any resulting proposed changes to state regulation and permitting. The discussions, comments and results of the workgroup sessions will be considered while the department drafts and finalizes the revised CAFO rule.
Please keep in mind that the Missouri Clean Water Commission, which Missouri Law has empowered to both implement and enforce the Clean Water Law, has expressly stated through regulation that the department lacks jurisdiction to address questions or concerns related to “non-water quality related items,” such as zoning, location and property values [10 CSR 20-6.020(H)]. Accordingly, discussion topics at the workgroup meetings must fall under the jurisdiction of the Missouri Clean Water Commission.
