UST Requirements of the Federal Energy
Policy Act of 2005
On Aug. 8, 2005, President Bush signed the Energy Policy Act of 2005 Title XV, Subtitle B of this act (entitled the Underground Storage Tank Compliance Act or USTCA of 2005). The USTCA contains amendments to Subtitle I of the Resource Conservation and Recovery Act -- the original legislation that created the UST program. This new law significantly affects the federal UST program and requires major changes to our state program. It also effects underground storage tank owners, petroleum marketers, manufacturers, installers and federal facilities.
The UST provisions of the Energy Policy Act focus on preventing releases. Among other things, it expands eligible uses of the Leaking Underground Storage Tank (LUST) Trust Fund, and includes provisions regarding inspections, operator training, delivery prohibition, secondary containment, financial responsibility and cleanup of releases that contain oxygenated fuel additives.
The department is holding stakeholder meetings to have discussions on the provisions with all interested parties. A posting of meeting dates and agendas will be available on this Web site.
The department will be maintaining the proceedings of meetings on this web site so that interested parties can keep abreast of the progress of the stakeholder meetings. This Web site will contain meeting notes, action items, draft statutes, regulations and other materials discussed in the stakeholder meetings.
